Welcome to KrimeScene. These Terms & Conditions ("Terms") constitute a binding legal agreement between you ("User," "you," or "your") and KRIMEWATCH FOUNDATION INC, a registered non-profit foundation ("KFI," "we," "us," or "our"), governing your access to and use of the KrimeScene mobile application and all associated services, features, software, and technologies (collectively, the "Services").
By installing, downloading, accessing, or using the Services in any way, you unconditionally accept and agree to be legally bound by these Terms and our Privacy Policy. If you do not agree to every provision of these Terms, you must immediately cease all use of the Services and uninstall the app.

KrimeScene is a community safety and awareness platform operated by KRIMEWATCH FOUNDATION INC (KFI). The Services currently include:
All Services are made available by KFI on a best-efforts basis for community awareness purposes only. KFI reserves the right to modify, expand, limit, or discontinue any feature of the Services at any time and for any reason, without liability to you.
You must be at least 13 years of age to use the Services. If you are between 13 and 17, you represent and warrant that your parent or legal guardian has read, understood, and agreed to these Terms on your behalf, and that they take full responsibility for your use of the Services.
By using the Services you represent and warrant that:
KFI reserves the right to verify eligibility and to deny access to any person who does not meet these requirements, without notice and without liability.
KrimeScene does not require you to create a traditional user account. There is no username, email address, or password registration. Instead, the Services use your device's unique mobile identifier ("Mobile Device ID" or "mobUID") to associate your activity and content within the app.
Content moderation. Your mobUID may be used by KFI to identify and manage violations of these Terms, including issuing warnings or restricting access to the Services. See Section 8 for details.
No transfer. You may not use methods to spoof, replicate, or transfer your mobUID to another device for the purpose of evading a content warning, restriction, or removal from the Services.
You agree to use the Services only for lawful, authorised, and acceptable purposes, consistent with these Terms and all applicable laws. You will not use the Services (or assist others in using the Services) in any manner that:
Violation of this section may result in an in-app warning, content removal, restriction of access, or permanent removal from the Services. Where conduct is serious or unlawful in nature, KFI reserves the right to refer the matter to the relevant governmental, regulatory, or public safety authorities. KFI accepts no liability for any actions taken by any governmental or regulatory authority in connection with your use of the Services.
The following conduct is expressly prohibited. Engaging in any of the following may result in an immediate in-app warning, content removal, permanent restriction of your device from the Services, and where appropriate, referral to relevant governmental or regulatory authorities:
Ownership. KFI does not claim ownership of content you submit through the Services ("User Content"). You retain all ownership rights you hold in your User Content.
Licence grant. By submitting any User Content you grant KFI a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, fully sublicensable and transferable licence to use, reproduce, display, distribute, transmit, modify, adapt, translate, create derivative works of, and otherwise exploit your User Content in any media or format now known or hereafter developed, solely for the purpose of operating, maintaining, improving, promoting, and growing the Services. This licence survives deletion of your content to the extent that your User Content has been shared with or accessed by other users prior to deletion.
Your representations and warranties. By submitting User Content you represent and warrant that:
No verification obligation. KFI is under no obligation to monitor, review, verify, or moderate any User Content. KFI accepts no liability for User Content that is inaccurate, false, misleading, harmful, illegal, or offensive.
Right to remove. KFI reserves the right — but assumes no obligation — to remove, edit, or restrict any User Content at any time and for any reason, without notice and without liability to you or any third party.
KrimeScene provides a community-based missing persons awareness feature that allows users to submit missing persons reports that are displayed to other users of the Services. This feature is intended solely to assist in spreading community awareness.
When you submit a missing persons report through the Services, you represent and warrant that:
Users may update the status of a missing persons report (for example, to indicate the person has been found). You are responsible for ensuring any status update you submit is accurate. Submitting a false status update is a violation of these Terms and may result in immediate restriction of your device from the Services.
KFI does not verify the accuracy of missing persons reports and accepts no liability for any harm arising from false, inaccurate, or misleading missing persons submissions. KFI reserves the right to remove any missing persons report that it determines, in its sole discretion, violates these Terms or is otherwise inappropriate.
KFI reserves the right to moderate content submitted through the Services to maintain community safety and compliance with these Terms. Our moderation approach includes the following:
If KFI determines that content submitted from your device violates or may violate these Terms, we may issue an in-app warning to your device (identified by your mobUID). Warnings may be issued for:
KFI may remove any content that violates these Terms, without notice and without liability. Removal of content does not obligate KFI to take further action, nor does it prevent KFI from taking further action including device restriction.
For serious or repeated violations, KFI may restrict or permanently block your mobUID from accessing the Services. Because KrimeScene is device-based rather than account-based, a device restriction affects all use of the Services from that device.
KFI's moderation efforts are made on a best-efforts basis. KFI does not guarantee that all inappropriate content will be identified, removed, or actioned promptly. KFI accepts no liability for content that remains visible on the platform pending moderation review.
KrimeScene is a community awareness and information-sharing platform only. KFI makes no guarantee, representation, or warranty that:
In an emergency, you must call 911 (USA), 112 (India/EU), or your local emergency number immediately. KFI expressly disclaims all responsibility for any injury, death, property damage, or other harm that arises from reliance on the Services in place of contacting official emergency services.
Your responsibility. You are solely responsible for obtaining and maintaining the device, software, and internet connection required to use the Services. KFI does not supply these.
Internet and data charges. Certain features require an active internet connection. KFI is not responsible for the Services failing to function at full capacity due to lack of connectivity. Mobile network charges — including roaming charges — remain your sole responsibility.
Device security. We strongly recommend against jailbreaking or rooting your device. Doing so may compromise security and may cause the KrimeScene app to malfunction or cease to work entirely. KFI accepts no liability for consequences arising from jailbroken or rooted devices.
Third-party data. Some content displayed in the Services is sourced from other users or third-party systems. KFI endeavours to present information in good faith but cannot guarantee its accuracy and accepts no liability for any loss arising from reliance on such content.
Updates. KFI may release app updates from time to time. You agree to install updates when prompted. KFI reserves the right to modify, suspend, or permanently discontinue the Services at any time and for any reason, without notice and without liability. Upon termination of the Services: (a) the rights and licences granted to you under these Terms end immediately; and (b) you must stop using the app and delete it from your device if directed to do so.
Fees. KFI will never charge you for the Services without providing clear and prominent advance notice of the fees and what they cover.
The Services may allow you to access or interact with third-party services necessary to support the app's functionality, such as cloud hosting, mapping, or push notification providers. When you engage with any third-party service:
Your use of any third-party service accessed through or in connection with KrimeScene is entirely at your own risk.
All content, features, functionality, and materials comprising the Services — including but not limited to the KrimeScene and KFI names, logos, trade marks, designs, software, source code, text, graphics, icons, and data compilations — are the exclusive property of KRIMEWATCH FOUNDATION INC or its licensors, and are protected by applicable copyright, trade mark, patent, and other intellectual property laws.
You may not, without KFI's prior express written consent:
Any unauthorised use constitutes an infringement of KFI's intellectual property rights and may result in legal action.
KrimeScene collects and processes a limited amount of data associated with your device in order to deliver the Services. Our Privacy Policy describes exactly what data we collect, how we use it, how we protect it, and your rights with respect to it. The Privacy Policy is incorporated into these Terms by reference.
By using the Services you agree to our data practices as described in the Privacy Policy. We comply with applicable data protection laws, including the GDPR (where applicable to you), the California Consumer Privacy Act (CCPA), and India's Digital Personal Data Protection Act, 2023 (DPDP Act). Please review the Privacy Policy carefully before using the Services.
In the interest of full transparency — and in compliance with applicable App Store and Play Store guidelines — this section provides a plain-language summary of our data practices:
KFI collects only the minimum data necessary to provide the Services:
KFI does not collect email addresses, passwords, usage analytics, screen view data, crash reports, system logs, IP address logs, advertising identifiers, browsing history, or data from third-party social media platforms.
Data is stored on secure cloud infrastructure. User-submitted content is retained until you remove it from the app or until KFI removes it in accordance with these Terms. Device identifiers are retained for as long as you use the Services. KFI does not sell, rent, or share your personal data with third parties for their own commercial purposes.
KFI uses trusted third-party cloud hosting providers to store and process data necessary to operate the Services. These providers act as data processors on our behalf and are contractually bound to protect your data. KFI does not currently use third-party artificial intelligence (AI) services to process your personal data. If this changes, the Privacy Policy will be updated accordingly.
KrimeScene does not capture, record, or store screenshots or screen recordings of your device activity. The app does not enable or facilitate the taking of screenshots beyond your device's standard operating system functionality.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS. KRIMEWATCH FOUNDATION INC (KFI), ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, VOLUNTEERS, PARTNERS, AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:
KFI does not endorse, verify, or guarantee the accuracy of any User Content, community-submitted report, or missing persons submission. Any reliance on information obtained through the Services is at your own risk and your own sole responsibility.
Some jurisdictions do not permit the exclusion of implied warranties. To the extent such laws apply to you, some of the above exclusions may not apply, but KFI's liability is still limited to the maximum extent permitted by law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KRIMEWATCH FOUNDATION INC (KFI), ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, VOLUNTEERS, AFFILIATES, PARTNERS, OR LICENSORS BE LIABLE FOR ANY:
— even if KFI has been advised of the possibility of such damages, and regardless of the form of action (whether in contract, tort, negligence, strict liability, or any other legal or equitable theory).
Aggregate liability cap. KFI's total cumulative liability to you for all claims of any kind arising from or related to the Services shall not exceed the greater of:
Essential basis. You acknowledge and agree that the disclaimers, exclusions, and limitations of liability in Sections 15 and 16 are essential elements of the agreement between you and KFI, and that KFI would not provide the Services without these protections.
Some jurisdictions do not allow the exclusion or limitation of certain damages. Where such laws apply, KFI's liability is limited to the minimum extent required by law.
You agree to fully defend, indemnify, and hold harmless KRIMEWATCH FOUNDATION INC (KFI), its officers, directors, employees, volunteers, agents, affiliates, partners, and licensors (collectively, the "KFI Parties") from and against any and all claims, actions, demands, proceedings, losses, liabilities, settlements, penalties, fines, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in any way related to:
KFI reserves the right to assume exclusive control of the defence of any matter subject to indemnification by you, at your sole expense. You agree to cooperate fully with KFI's defence of such claims and not to settle any such matter without KFI's prior written consent.
To the maximum extent permitted by applicable law, you hereby release and forever discharge the KFI Parties from any and all claims, demands, actions, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, arising out of or in any way related to:
If you are a California resident, you expressly waive the protections of California Civil Code § 1542, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You acknowledge the significance of this waiver and agree to it nonetheless.
By you. You may stop using the Services at any time by uninstalling the app. To request removal of your device's data and content from our systems, contact us at contact@krimewatch.com.
By KFI. KFI may, at its sole discretion and without liability to you, suspend, restrict, or permanently block your mobUID's access to the Services at any time, with or without notice, including where we believe you have violated these Terms, engaged in prohibited conduct, or where action is required to protect other users or third parties.
Effect of termination. Upon termination or restriction of your access, your right to use the Services ceases immediately. The following sections survive termination: 6 (licence for previously shared User Content), 12, 15, 16, 17, 18, 20, and 21.
KFI is not liable to you or any third party for any termination or restriction of your access to the Services.
These Terms are governed by and construed in accordance with the laws of the United States of America and India (as applicable based on your location and the nature of the dispute), without regard to conflict-of-law principles.
Informal resolution. Before initiating any legal action, you agree to first contact KFI at contact@krimewatch.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days.
Jurisdiction. If a dispute cannot be resolved informally, you and KFI each irrevocably consent to the jurisdiction of the competent courts of the United States of America (for US-based disputes) or India (for India-based disputes), as applicable.
Class action waiver. To the extent permitted by law, you and KFI each waive any right to bring or participate in a class action, collective action, or representative proceeding of any kind against the other in connection with the Services or these Terms.
If you are located outside the United States or India, mandatory local consumer protection laws in your jurisdiction may afford you rights that cannot be contractually waived, and nothing in these Terms limits those rights.
Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and KFI regarding the Services and supersede all prior agreements, understandings, and representations.
Severability. If any provision is found invalid or unenforceable, it shall be limited to the minimum extent necessary, and the remaining provisions continue in full force.
No waiver. KFI's failure to enforce any right or provision shall not constitute a waiver. Any waiver must be in writing and signed by an authorised KFI representative.
Assignment. You may not assign your rights under these Terms without KFI's prior written consent. KFI may freely assign these Terms in whole or in part without notice.
No third-party beneficiaries. These Terms do not create any third-party beneficiary rights. No person or entity other than you and KFI has any right to enforce these Terms.
Force majeure. KFI shall not be liable for any failure or delay caused by circumstances beyond its reasonable control, including acts of God, natural disasters, war, civil unrest, government actions, internet outages, power failures, or third-party service failures.
Language. These Terms are drafted in English. In the event of a conflict between the English version and any translation, the English version controls.
KFI reserves the right to update or modify these Terms at any time and for any reason. When changes are made, we will update the "Last Updated" date at the top of this page. For material changes, KFI will also provide notice via the app where reasonably practicable.
Your continued use of the Services following the posting of updated Terms constitutes your unconditional acceptance of the revised Terms. If you do not agree to the updated Terms, you must immediately stop using the Services and uninstall the app.
